U.S. States’ Proposals to Ban Real Estate Buys from Chinese Investors Face Legal Challenges
State-level proposals to ban Chinese investors from the real estate market might face legal challenges, experts say. Several U.S. states, including Texas, Florida and Arkansas, are proposing legislation to ban citizens from China from buying residential properties. “If adopted into law, these proposals will eventually be overturned as discriminatory under U.S. constitutional law. They would also almost certainly be illegal under World Trade Organization agreement, and could be challenged by China there,” said Michael Byers, professor of international law at the University of British Columbia. A handful of governments have initiated measures that directly or indirectly bar foreigners from purchasing homes or real estate, including Canada, Switzerland, Denmark, Singapore, Cambodia and many others. But these measures are not discriminating against citizens of a particular country, he said. South China Morning Post
