U.S. appeals court to reconsider ban on felons possessing guns

The 9th Circuit vacated a ruling that struck down a federal ban on felons owning firearms, prompting a conservative judge to claim his “Left Coast” colleagues want to “subvert” the U.S. Supreme Court‘s holdings expanding gun rights. The court said a majority of its 29 judges had voted to vacate the three-judge panel’s ruling and have a larger panel rehear the case. Nate Raymond has more.

The May decision came from a panel comprised of only appointees of Republican presidents including U.S. Circuit Judge Lawrence VanDyke, who issued a rare dissent to the 9th Circuit’s decision to hear the case en banc.

Lawyers want $122.5 million in Apple securities case

Attorneys who reached a $490 million securities class action settlement with Apple earlier this year are hoping to walk away with a quarter of that amount in legal fees, arguing that the risks they took warrant a hefty reward. Lawyers at Robbins Geller Rudman & Dowd and Labaton Keller Sucharow this week asked a federal judge to award them $122.5 million, or about $3,100 an hour for the 65 lawyers and staffers who together devoted 39,500 hours to the case, according to the firms’ filings. Merck defeats appeal by nearly 1,200 shingles vaccine plaintiffs

The 3rd Circuit ruled on Tuesday that a Philadelphia federal judge did not abuse his discretion when he tossed nearly 1,200 cases after plaintiffs failed to comply with a Lone Pine order requiring them to produce clinical test results that would conclusively prove they developed shingles as a result of exposure to the virus contained in Merck’s Zostavax vaccine and not from past exposure to the chicken pox virus. Plaintiffs said the judge knew that evidence simply wasn’t available and should have allowed them to offer alternative ways to prove causation in summary judgment briefing. The 3rd Circuit disagreed.
