Fox News affiliates lost their bid Friday for heightened legal protections against a $1.6 billion defamation lawsuit brought by Dominion Voting Systems Inc. over the network’s alleged role in spreading false conspiracy theories about the 2020 election.
Judge Eric M. Davis denied Fox’s request to apply the elevated summary judgment standard found in New York’s anti-SLAPP law. The statute provides extra procedural safeguards in some cases for media outlets or others facing legal claims that could potentially chill constitutionally protected speech.
