Judge Stephen Vaden of the U.S. Court of International Trade is believed to be the second judge to ask lawyers to disclose their use of generative AI tools to create legal documents.
Earlier this month, U.S. District Judge Brantley Starr of the Northern District of Texas asked lawyers in his court to certify that they did not use AI tools, such as OpenAI’s ChatGPT, to draft their filings without a human checking their accuracy.
The restrictions on AI use in courtrooms come after a New York lawyer in an unrelated case admitted to including made-up case citations generated by ChatGPT in a legal brief.
