State abortion Laws… North Carolina’s legislature passed a bill that limits the window for most abortions to 12 weeks. In Utah, a court temporarily blocked a new state law that would effectively end abortions by making it impossible to get a license for a clinic where they are performed. And the U.S. Supreme Court declined to hear a challenge to the legality of an Indiana requirement that abortion providers bury or cremate embryonic or fetal remains following the procedure. Here is a snapshot of pending and passed legislation seeking to restrict or protect access in 2023.
In the judiciary… A coalition of progressive groups is calling to put an end to the “blue slip” tradition that allows senators to block the president’s judicial nominees for district courts in their states. Meanwhile, the Senate confirmed several nominees to judgeships. Montana law professor Anthony Johnstone became President Joe Biden’s seventh appointee to the 9th Circuit. Two former federal prosecutors secured lifetime appointments as judges on the New Jersey federal trial court. A top lawyer in the New York attorney general’s office was narrowly confirmed to the Brooklyn federal court. Biden also nominated four federal judges to posts in Michigan, Pennsylvania, Connecticut and Washington, D.C. Also this week, midnight became the 3rd Circuit’s afternoon after the Philadelphia-based court changed its filing deadline to 5 p.m. on the day they are due.

This week, a former FBI agent was arrested for his alleged role in the Jan. 6, 2021, attack on the U.S. Capitol, and a jury convicted four members of the far-right Proud Boys militia group of seditious conspiracy.
