U.S. appeals court rebuffs Trump request to reconsider gag order in 2020 election case

The D.C. Circuit declined to reconsider its decision to largely uphold a judge’s order limiting former President Donald Trump’s statements about people involved in the federal case accusing him of plotting to overturn the results of the 2020 election. Trump can appeal the ruling to the U.S. Supreme Court, his last remaining hope of overturning limits on his public statements about potential witnesses, prosecutors and court staff involved in the case. The decision comes the same day as New Hampshire’s pivotal primary election where voters will choose whether to give Donald Trump a smooth glide to the Republican presidential nomination or bolster rival Nikki Haley’s longshot bid to topple him.

Verizon’s $100 million settlement gets thumbs down from lawyers for 10,000 customers

Alison Frankel wrote last week about Verizon’s stealthy class action settlement, in the face of a mass arbitration campaign, to resolve allegations that it deceptively charged fees to wireless customers. Verizon chose to settle, Frankel wrote, rather than defend its controversial “bellwether” arbitration rules at the 9th Circuit and the New Jersey Supreme Court. Now a set of plaintiffs lawyers say they represent nearly 10,000 Verizon customers who still want to arbitrate. Frankel has the details on the latest mass arbitration mess.
